Terms of Service

1. Acceptance

These Terms of Service ("Terms") govern your access to and use of the goldapi.dev website, API, documentation and related services (the "Service") provided by Gold Timo ("we", "us", "our"). By creating an account, buying a paid plan or otherwise accessing the Service, you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms by posting a new version and its effective date here. Earlier versions are available on request from [email protected].

2. The Service

The Service provides spot prices for gold, silver, copper, platinum and palladium from third-party market data providers, prices in other currencies calculated from the USD price and exchange rates, and, on the plans that include them, daily history and daily OHLC candles.

The data is not an official benchmark, and we hold no licence from any benchmark administrator.

3. Accounts and API keys

You are responsible for all activity under your account. API keys are confidential: keep them secret, do not share or resell them, and disable a key from your account page if it is exposed. Tell us at [email protected] about any suspected compromise.

We may disable API keys to protect the Service, including in response to suspected abuse, a leaked key or a violation of these Terms.

4. Plans and payment

The plans and their current prices are on the pricing page. A paid plan is a one-time payment for the period you choose, made in cryptocurrency through our payment provider, InzoPay, under its own terms. It does not renew by itself. When the period ends, your account moves back to the Free plan until you buy again. Renewing early adds the new period to the time remaining.

No refunds. Payments are non-refundable, including for unused time. In cases of serious service disruption, we may offer an accommodation at our discretion.

Price changes. Prices may change at any time for future purchases. A period you already paid for is not affected.

Taxes. Prices do not include taxes. Taxes are your responsibility under your local rules.

5. Acceptable use

You agree not to use the Service to violate any law; interfere with or degrade the Service; access its non-public parts; get around rate limits, authentication or plan limits; share keys to get around those limits; scrape or bulk-export data beyond what your plan permits; or build a competing API product that primarily resells our data. A violation may result in suspension or termination without refund.

6. Commercial use and redistribution

Free plan: commercial use is permitted with a visible link to goldapi.dev near the prices shown. Paid plans: commercial use is permitted and no credit is required. On every plan, internal business use requires no credit.

Your plan's rights apply on any number of websites and apps operated by you or by companies that control, are controlled by, or are under common control with you.

• Display in your products. You may show prices, and values you derive from them such as karat prices or your own buy and sell prices, to end users of your products and services.
• No redistribution. On any plan, you may not resell, redistribute, sublicense or pass on raw or derived data through your own API, SDK, data feed, file export or dataset, or build a competing data product from it, without a separate written agreement. Contact [email protected].
• Your own compliance. Some uses, including investment products and regulated financial instruments, may require your own licences from benchmark administrators, exchanges or venues. We grant no such licence.
• No misrepresentation. You may not present our data as an official benchmark or as licensed from any benchmark administrator.

7. Data and accuracy

Data is provided "as is". We make no warranty that it is accurate, complete, current or fit for any particular purpose. Do not use the Service as the only data source for safety-critical, regulatory or high-value financial decisions without checking the data independently.

Each price comes with the time it was computed. Check that time and handle old data appropriately.

8. Rate limits

Each plan has an hourly request limit and its own features, shown on the pricing page. Over the limit, the API answers HTTP 429 with a Retry-After header, and requests work again when the next hour starts. There is no overage billing. Persistent abuse may result in suspension.

9. Availability

No plan carries a service level agreement, automatic credits or remediation obligation.

10. Communications

We send emails needed to run your account, such as sign-up codes, password resets and plan notices. You cannot opt out of them while your account is active.

11. Privacy

The Privacy Policy describes the data we collect and how we use it.

12. Intellectual property

You keep all rights to what you submit to the Service. We keep all rights to the Service itself, including its code, data products, branding and documentation. The limited rights you receive are described in section 6. No other licence is granted.

13. Third-party services

The Service relies on third-party providers, listed in the Privacy Policy. Each is governed by its own terms. We are not responsible for their outages, breaches or policy changes.

14. Termination

We may suspend or terminate your account for violation of these Terms, fraud, abuse or a legal requirement, with or without prior notice. Fees already paid are non-refundable. You may ask us to close your account at any time by emailing [email protected].

15. Disclaimers

Informational use only. The Service provides reference data for informational purposes. Nothing in it is investment, financial or tax advice, or a licensed financial product. You are solely responsible for decisions made using the Service.

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement or accuracy of data. We do not warrant that it will be uninterrupted or error-free.

16. Limitation of liability

To the extent the law allows, we exclude liability for indirect or consequential losses, lost profits and lost data, and for losses from trading, investment or other financial decisions made using the data. If money claims remain available, our total liability for all claims relating to the Service is limited to the fees you paid for it in the 12 months before the claim.

17. Indemnification

You agree to indemnify, defend and hold us harmless from claims, damages, liabilities and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms or your violation of third-party rights.

18. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Disputes are resolved in the courts of the State of Delaware, except where you have non-waivable rights to a local forum under applicable consumer law. For smaller disputes, both parties agree to first try to resolve them informally by email.

19. Miscellaneous

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.

Severability. If any provision is found unenforceable, the rest continues in effect.

No waiver. Our failure to enforce a provision is not a waiver of future enforcement.

Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or acquirer in connection with a merger, acquisition or sale of assets.
